Beginning with the 2017 school year, the Texas Education Agency (TEA) changed the way it reports special education enrollment in school systems. PROCEDURAL SAFEGUARDS NOTICE

This guide was was developed by the statewide leadership for the Legal Framework project team and the Texas Education Agency (TEA) in response to the requirement in the Texas Education Code §26.0081. This guide is designed to give you, as the parent of a child who is  or may be eligible for special Education and related services, a better understanding of the special education process and fo your procedural rights and responsibilities so that you will be able to fully participate in the decision-making process regarding your child's education. 

The Individuals with Disabilities Education Act (IDEA), as amended in 2004, requires schools to provide parents of a child with a disability with a notice containing a full explanation of the procedural safeguards available under IDEA and its implementing regulations. This document, produced by the Texas Education Agency (TEA), is intended to meet this notice requirement and help parents of children with disabilities understand their rights under IDEA.

Esta guía fue desarrollada por el liderazgo estatal para el equipo del proyecto del Marco Legal y la Agencia de Educación de Texas (TEA) en respuesta al requisito del Código de Educación de Texas §26.0081. Esta guía está diseñada para brindarle a usted, como padre de un niño que es o puede ser elegible para educación especial y servicios relacionados, una mejor comprensión del proceso de educación especial y de sus derechos y responsabilidades de procedimiento para que pueda participar en el proceso de toma de decisiones con respecto a la educación de su hijo.

La Ley de Educación para Individuos con Discapacidades (IDEA), según enmendada en 2004, requiere que las escuelas proporcionen a los padres de un niño con una discapacidad un aviso que contenga una explicación completa de las garantías procesales disponibles bajo IDEA y sus regulaciones de implementación. Este documento, elaborado por la Agencia de Educación de Texas (TEA), está destinado a cumplir con este requisito de notificación y ayudar a los padres de niños con discapacidades a comprender sus derechos según IDEA.
